Who are you - a mark or a man?

A brief explanation to give a basic understanding of the Law of Persons. It is all up to you to know who you are and to remove controversy in your life.

The misnomer “WE, the PEOPLE”

Previous articles have covered the distinction of “WE, the PEOPLE”. However, it may not have made sense before the more recent posts. So, time to revisit. Lets start with the basics.

“WE the PEOPLE” was a reference to the people in the new Congress established by the Confederation of States doing business as the States of America. The Constitution was crafted to handle international commerce, and treaties, and other global business. These were Legal Persons acting as PEOPLE. They were the PEOPLE in congress [“meeting”] assembled who took on a title and role in government. The styling of CAPITALIZATION will be covered in this article.

PINCH YOURSELF!

Okay, now that you got that out of the way, you should know you are made of flesh and blood. It hurts when you get pinched [“for most people anyway”]. That same flesh and blood has a conceived gender. So, regardless if you “identify” as any particular gender, you are real and conceived as a certain sex. This is independent of how out-of-sorts one may feel in that body, and how that leads to other choices [“conscious or not”].

This is biologically true from the fact that 1000 years from now, when archaeologists dig up your bones and do an analysis of those bones and DNA, the test results will be two options: born either a man or a woman. They will not care about your choice on the gender you selected and pronoun you picked; unless you leave a note in the box.

This is a clarifying baseline to understand how the law looks at people versus persons. This has nothing to do with any sensitivity to the emotional and physical challenges some people truly face on a day-to-day basis.

However; by choosing to be a name, pronoun, or face other than the sex from which you are conceived, will dictate how you are treated by the legal society - and by extension, our Federal [“territorial and municipal”] government.

God has no respect for “persons”

From a previous article, passages were shared from the bible that specifically talks about the idea of persons [“yes, it is an idea - a legal fiction - a construct of the mind”]. From this idea is where person(s) originate. In Roman Law it means basically the same thing as it does in the bible. We create persons by choice. Those choices have consequences.

Deuteronomy 1:17 – Ye shall not respect persons in judgment; but ye shall hear the small as well as the great; ye shall not be afraid of the face of man; for the judgment is God’s: and the cause that is too hard for you, bring it unto me, and I will hear it.

There are two words for “person” in Hebrew: nephesh (inner person - breathing creature - Strong’s Concordance 5315). This is the combination of body and soul. The other word is shem (outer person - the name or face - Strong’s Concordance 8034). Shem is the reference to “name” or “face”. It is the face of a man. It is what you show the world at any particular point in time. It is a choice.

Now look at the definition of “Title” again as shared in previous articles:

TITLE. The radical meaning of this word appears to be that of a mark, style, or designation; a distinctive appellation; the name by which anything is known. Thus, in the law of persons, a title is an appellation of dignity or distinction, a name denoting the social rank of the person bearing it; as "duke" or "count."

Notice how both the biblical “shem” and the legal word “title” mean the same thing?

Common Law deals with the body and soul as a Lawful Person. The Government [“an entity”] deals with the face, title, or mark as the Legal Person. A man is governed by Natural Law and is a living soul.

Which do you think is sovereign?

• Man or woman - living soul - spirit - conceived

• Lawful Person - the inner person, creature, breathing, plus lawful name [“combination of an owned name and the spirit/living soul'“]

• Legal Person - the outer face, mark, and legal name

The presumption

The importance of this discussion is how the legal system looks at persons.

• The face, name, title, and mark is what is prosecuted in legal codes, acts, rules, and statutes. This is done by judgement or jury trial.

• The whole man plus name is what is on trial in Common Law. This is through peers and trial-by-jury.

• By Natural Law, the spirit is what is the creation of Creation. It is the author of law.

That is why we claim our name rather than being our name. But, you must know who you are before standing as a man or Lawful Person. You must recognize if you signed an agreement that makes you a Legal Person. All these legal constructs are voluntary and are created as temptations to entice us to give up freedom and rights. The government courts will ALWAYS presume you are a Legal Person. It is your responsibility to know who you are and remove the controversy.

If you do not know who you are, and you take on being a name, pronoun, or face; and sign an agreement binding you to a face, then you are subject to the legal codes, rules, acts, and statutes of the fictitious government. Fiction judges fiction. And you are now marked!

If you are unaware of the difference, the living soul ends up caught in the cross fire.

“Inasmuch as every government is an artificial person, an abstraction, and a creature of the mind only, a government can interfere only with other artificial persons. The imaginary, having neither actuality nor substance, is foreclosed from creating and attaining parity with the tangible. The legal manifestation of this is that no government, as well as any law, agency, aspect, court, etc. can concern itself with anything other than corporate, artificial persons and the contracts between them.” Penhallow v Doane’s Administrators, 3 U.S. 54 (1795) at p 93.

Notice how deciding to be what you are not (Legal Person), and thus, being artificial, you are subject to government? The presumption is you need representation as you are not capable of being the man or woman.

A person is: “a variety of entities other than human beings.” Church of Scientology v U.S. Department of Justice, 612 F2d 417 (1979) at pg 418.

“ ‘in common usage, the term ‘person’ does not include the sovereign, [and] statutes employing the [word] are normally construed to exclude it.’ Wilson v Omaha Tribe, 442 US653 667, 61 L. Division of man, persons, and the Government

The chart above shows the separation between people, Lawful Persons, and Legal Persons as established in our original government. The power in America was supposed to flow from the people down the left side of the chart and then down the right side of the chart.

The right side of this chart shows where we “reside” if we so choose. It is where “persons” have “motor vehicles” and “real property”.

Notice on the left is a combination of soil, land, and sea jurisdictions. The land and soil are where we live and have our homes. And the duties not delegated [“enumerated”] in the constitutions are held by the Lawful side of the People. It is a Republic in nature, but not a Republican Government. We did not have an actual full time government that needed to justify its existence at the state level originally. It was an organized community of citizens basically volunteering through local, county and state community approval; and people were held to account for their behavior. Super simple and similar to original community self governance.

Black's Law Dictionary 2nd Edition:

REPUBLICAN GOVERNMENT. A government in the republican form; a government of the people; a government by representatives chosen by the people. See In re Duncan, 139 U. S. 449, 11 Sup. Ct. 578, 35 U Ed. 219 ; Eckerson v. Des Moines, 137 Iowa, 452, 115 N. W. 177 ; Minor v. Happersett, 21 Wall. 175, 22 L. Ed. 627; Kadderly v. Portland, 44 Or. 118, 74 Pac. 710.

REPUBLIC. A commonwealth; a form of government which derives all its powers directly or indirectly from the general body of citizens, and in which the executive power is lodged in officers chosen by and representing the people, and holding office for a limited period, or at most during good behavior or at the pleasure of the people, and in which the legislative power may be (and in modern republics is) entrusted to a representative assembly. See Federalist, No. 39; Republic of Mexico v. De Arangolz, 5 Duer (N.Y.) 030; State v. Harris, 2 3ailey (S. C.) 599.

In a wider sense, the state, the commonwealth, the whole organized political community, without reference to the form of government; as in the maxim interest reipublica ut sit finis litium. Co. Litt 303.

Notice how a Republican Government is an actual government. A Republic is a form of government without a reference to a specific actual government. It is the community coming together to self govern and push their powers through government structures with the people in those communities ultimately being sovereign and the author of law. This is an important distinction to understand how the founding fathers setup our country. It is still that way today if we choose to exercise our sovereign power.

Names

As was shown in previous articles, names are given and taken. So, a name is an outer person. It is claimed.

Simple example: if you travel and use your passport, the officer performing his duty to inspect the passport asks you, “Is this you?”, while pointing to your passport photo. The reality is that piece of paper is not you. It is a confusing question. It requires clarification. That simple question invokes a ton of questions/comments. “i, do not understand the question.” “Do you think that piece of paper is me?” “Are you asking if i, am in the paper?” “i, am in front of you, and that is simply a piece of paper to stamp as i, pass through a port with the information verifying i, own authority to travel.” “Is it not a free pass to go through a port?”

Another example is the Birth Certificate. It even notes on the certificate that it is not to be used for identification. If you say “yes” that it is you, when asked if it is you, then you have just become a Legal Person, a piece of paper, a fictitious entity, a creature of the mind, a legal fiction.

If you did not wrong or harm another man, and you are not employed by, an officer of, or a named “person” in a contract of corporations, you should not be tried in a legal society court. If you simply charter your corporation to do business with another corporation, and you volunteer your time with no title, [“including the title owner - you own property”], then you are simply a man. You are owed all protections of the constitutions when crossing over into international jurisdiction. That is what the Bill of Rights clarify. They are the rights protected when operating as a man in the jurisdiction of the government [“sea or air”]. But, that does not stop presumption of a Legal Person status from happening as a result of almost every court “in” the land is MUNICIPAL now; and people do not know who they are.

This proliferation of legal courts at the local level is due to local governments contracting with the Federal Government. Those local governments start receiving benefits and privileges from that same government through grants and funding. The local government then becomes MUNICIPAL [“frequently through the process of incorporation”], and has the district attorneys create [“or be responsible for”] forms, and following the “rules of civil procedure” that dictate how those courts behave. An agreement is created that “subjects” the local level to the Federal Government. It is an inversion of our established sovereign people. And we allowed it to happen.

Names entrap people. You claim your name; you are not your name. Civil legal society courts put names [“the face - fictitious entity - creature of the mind - artificial persons - shem”] on trial through a “jury trial”. This is lawyers interviewing and selecting the jury and the lawyers representing you.

This is far different from a trial-by-jury. A trial-by-jury includes actual peers who have a status of civilians on the land with a political status of State National or State Citizen. These people are to be from the district and county where a trespass occurs. They should be picked completely randomly. You stand as a man or woman and you can have counsel.

Lawyers and attorneys are licensed. They have an oath to a guild that supersedes the people. Counsel is not licensed. Lawyers are compromised. Counsel is a skilled man or woman who know the law and who does help their fellow man.

People versus Persons

The styling of names:

When a legal document is sent to the postal address you use, it is something from the current persons court [“MUNICIPAL”], it is stylized in all CAPS. See what this means? A slave to Rome. Look at the mail. Capitalized names assumes a fictitious entity.

There are methods to correct this misaddressing. But, that requires much more explanation. Bottom line, know who you are. If you do choose to be a name or pronoun, or some other “face”, there are inherent risks. Law has no respect for persons. Why should they? The Creator has no respect for persons. Persons create controversy. The legal society thrives on controversy.
